‘Unconstitutional Sanctions’

The family of independent UN Special Rapporteur Francesca Albanese has filed a lawsuit against the Trump administration, arguing that US sanctions imposed on her over her criticism of Israel violate constitutional free speech protections.

According to a report published by The Guardian, the lawsuit was filed on Wednesday in the US District Court in Washington. The filing was brought by Albanese’s husband and minor child, outlining what they describe as the severe personal and professional consequences of the sanctions.

“Francesca’s expression of her views about the facts as she has found them in the Israeli-Palestinian conflict and about the work of the ICC is core First Amendment activity,” the lawsuit states, referring to the International Criminal Court.

The ICC has issued arrest warrants against Israeli officials, including Prime Minister Benjamin Netanyahu, over allegations of war crimes.

The filing argues that the case centers on whether the government can punish an individual “because Defendants disagree with their recommendations or fear their persuasiveness.”

“At its heart, this case concerns whether Defendants can sanction a person – ruining their life and the lives of their loved ones, including their citizen daughter – because Defendants disagree with their recommendations or fear their persuasiveness,” the lawsuit says.

The White House did not immediately respond to requests for comment, while a State Department spokesperson declined to comment on pending litigation, according to The Guardian.

Sanctions and Political Pressure

Albanese serves as the UN special rapporteur for the occupied Palestinian territories, appointed by the 47-member UN Human Rights Council in Geneva. Her mandate includes investigating alleged human rights abuses in the Palestinian territories.

She has repeatedly described Israel’s conduct in Gaza as genocide, a charge rejected by both Israel and the United States. Washington provides military support to Israel and had previously criticized what it called Albanese’s “campaign of political and economic warfare” against the US and Israel.

The sanctions were imposed in July after an unsuccessful US pressure campaign to remove Albanese from her UN post.

Shortly after the sanctions were announced, Albanese told the Associated Press that the measures would have serious personal consequences.

“My daughter is American. I’ve been living in the US and I have some assets there. So of course, it’s going to harm me,” she said at the time. “What can I do? I did everything I did in good faith, and knowing that, my commitment to justice is more important than personal interests.”

According to the lawsuit, the sanctions have affected the family’s ability to access their home in Washington and disrupted their financial and professional stability.

Despite the sanctions, Albanese has continued publishing reports sharply critical of Israeli policies in Gaza and the occupied West Bank. Her latest report focused on Israel’s “genocidal economy” in the Palestinian territories.
