New legislation enabling death penalty against Palestinians sparks international alarm, with rights groups warning it entrenches apartheid and violates international law.

- Amnesty and rights groups warn of an apartheid framework and due process violations.
- Legislation imposes execution within 90 days and excludes illegal Israeli Jewish settlers.
UN Experts: Institutionalizing Discriminatory Killing
UN experts on Thursday sharply condemned the newly adopted Israeli law enabling the death penalty against Palestinians, warning that it represents a direct violation of international human rights law.
“Israel’s new law, effectively providing for the death penalty solely against Palestinians, constitutes a discriminatory regime of capital punishment,” the experts said in a statement, as reported by the Anadolu news agency.
They added that the legislation “manifestly violates Israel’s obligations under international human rights law” and called for its immediate repeal.
“We condemn the Knesset’s adoption of this law, (which) marks a grave escalation in Israel’s discriminatory oppression of Palestinians,” the statement read.
The statement, signed by multiple UN special rapporteurs, also warned that the law undermines fundamental legal protections, including the right to life and equality before the law: “By reintroducing capital punishment in a system that targets solely Palestinians, (…) this law institutionalizes arbitrary and discriminatory deprivation of life.”
The experts raised alarm over provisions allowing military trials for civilians and execution by hanging, noting that such measures violate the prohibition of “torture and cruel, inhuman or degrading treatment.”
They stressed that the law reinforces an already existing dual legal system in the occupied West Bank, where Palestinians are subjected to military courts with limited due process protections, while illegal Israeli Jewish settlers are excluded from such measures.
“A law that effectively singles out Palestinians for execution conveys that Palestinian lives are less worthy of legal protection.”
The experts urged Israel’s Supreme Court to intervene and invalidate the legislation, warning that its implementation could result in “irreversible harm.”
Amnesty: Deepening Apartheid System
Additionally, a joint statement issued by Amnesty International and dozens of international organizations on Thursday described the law as a major legal and political regression that formalizes discriminatory punishment along ethnic and national lines.
The statement warned that the legislation effectively makes the death penalty mandatory in the West Bank, while applying “de facto exclusively to Palestinians.”
Although Israeli law has historically allowed capital punishment in rare cases, executions have not been carried out since 1962. The new law marks a decisive shift by expanding its use across both military and civilian courts while weakening basic legal safeguards.
The law allows military courts to impose death sentences by simple majority, without requiring prosecutorial approval, and mandates that executions be carried out within 90 days, with no possibility of commutation or pardon.
It also introduces execution by hanging under conditions of secrecy, alongside restricted access to legal counsel and oversight.
Crucially, the law explicitly excludes illegal Israeli Jewish settlers in the occupied West Bank, reinforcing what rights groups describe as a system of legal segregation.
“While the law does not explicitly reference ethnicity, it is effectively designed to target Palestinians exclusively,” the statement read.
The organizations stressed that the legislation violates core international legal frameworks, including the Fourth Geneva Convention, the International Covenant on Civil and Political Rights, and the Convention Against Torture.
They argued that the measure must be understood within a broader pattern of policies targeting Palestinians, including forced displacement, settlement expansion, and systematic repression.
The statement also referenced the International Court of Justice’s advisory opinion, which found that Israeli practices in the occupied Palestinian territory violate prohibitions on racial segregation and apartheid.
Calling for immediate action, the organizations urged the European Union to move beyond diplomatic statements and take concrete measures, including suspending the trade component of the EU-Israel Association Agreement.
